Corporations have the right to buy, sell, and own property. Corporations may make legal contracts, hire and fire workers, set prices, and be sued, fined, and taxed. A business must obtain a charter of incorporation from a state legislature or Congress to be legally recognized as a corporation."(Watson, p211) While corporations didn't exist until the mid to late 1800s, the idea of the corporation had existed since the early 1600s. It all started with English merchants who started trading companies to help fund the early colonies. If the colonies thrived, the stockholders reaped in the profit. (Watson, p211) A corporation is started when a sole proprietorship, a one-owner business, that is the most common form of business institution in the US, or a partnership, an association of two or more people in order to run a business, decides that they don't want to be personally responsible for any loss the company might have. (Watson, p211) Or they might decide that they want the company to "live on" after they die, that is for the business to have "unlimited life". Since neither of these goals can be reached with a sole proprietorship, or a partnership, the owner (or owners, as the case may be) decide that he (they) want to "convert" their business to a corporation. The owner(s) file a charter of incorporation from the government to be legally recognized as a corporation. (Boyd, March, 99) The owner(s) then sell shares of stock, documents representing ownership in the corporation, to investors. Brady Act Background Checks, History, and Application The Brady Handgun Violence Prevention Act is perhaps the most controversial federal gun control law enacted since the Gun Control Act of 1968, and several events in the U.S. led to its creation and enactment. In an effort to deny guns to those who would misuse them, it requires firearms dealers to perform an automated background check on prospective buyers of all rifles, shotguns or handguns. Brady Bill History On March 30, 1981, 25-year old John W. Hinckley, Jr. tried to impress actress Jodi Foster by assassinating President Ronald Reagan with a .22 caliber pistol. While he accomplished neither, Hinckley did manage to wound President Reagan, a District of Columbia police officer, a Secret Service agent, and White House Press Secretary James S. Brady. While he survived the attack, Brady remains partially disabled. Driven largely by the reaction to the assassination attempt and Mr. Bradys injuries, the Brady Act was passed, requiring background checks on all persons attempting to purchase a firearm. These background checks must be performed or applied by federally licensed firearms dealers (FFLs). NICS: Automating the Background Checks Part of the Brady Act required the Department of Justice to establish the National Instant Criminal Background Check System (NICS) which can be accessed by any licensed firearms dealer by telephone or any other electronic means for immediate access to any criminal information on prospective gun purchasers. Data is fed into the NICS by the FBI, the Bureau of Alcohol, Tobacco, and Firearms, and state, local, and other federal law enforcement agencies. Who Cannot Buy a Gun? Between 2001 and 2011, the FBI reports that over 100 million Brady Act background checks were performed, resulting in more than 700,000 gun purchases being denied. People who may be prohibited from purchasing a firearm as a result of data obtained from the NICS background check include: Convicted felons and people under indictment for a felonyFugitives from justiceUnlawful drug users or drug addictsIndividuals who have been determined to be mentally incompetentIllegal aliens and legal aliens admitted under a non-immigrant visaIndividuals who have been dishonorably discharged from the militaryPeople who have renounced their American citizenshipPeople under domestic violence restraining ordersPeople convicted of misdemeanor domestic violence crimes Note: Under current federal law, being listed on the FBI Terrorist Watchlist as a suspected or confirmed terrorist is not grounds for denial of a firearm purchase. Possible Outcomes of a Brady Act Background Check A Brady Act gun buyer background check can have five possible outcomes. Immediate Proceed: The check found no disqualifying information in the NICS and the sale or transfer can proceed subject to state-imposed waiting periods or other laws. Of the 2,295,013 NICS checks done during the first seven months the Brady Act was enforced, 73% resulted in an Immediate Proceed. The average processing time was 30 seconds.Delay: The FBI determined that data not immediately available in the NICS needs to be found. Delayed background checks are typically completed in about two hours.Default Proceed: When a National Instant Criminal Background Check System check cannot be completed electronically (5% of all checks), the FBI must identify and contact state and local law enforcement officials. The Brady act allows the FBI three business days to complete a background check. If the check cannot be completed within three business days, the sale or transfer may be completed although potentially disqualifying information might exist in the NICS. The dealer is not required to complete the sale and the FBI will continue to review the case for two more weeks. If the FBI discovers disqualifying information after three business days, they will contact the dealer to determine whether or not the gun was transferred under the default proceed rule. Firearm Retrieval: When the FBI finds that a dealer has transferred a gun to a prohibited person due to a default proceed situation, local law enforcement agencies, and ATF are notified and an attempt is made to retrieve the gun and take appropriate action, if any, against the buyer. During the first seven months, the NICS was in operation, 1,786 such firearms retrievals were initiated.Denial of Purchase: When the NICS check returns disqualifying information on the buyer, the gun sale is denied. During the first seven months of NICS operation, the FBI blocked 49,160 gun sales to disqualified people, a denial rate of 2.13 percent. The FBI estimates that a comparable number of sales were blocked by participating state and local law enforcement agencies. Typical Reasons for Denial of Gun Purchases During the first seven months in which Brady Act gun buyer background checks were performed, the reasons for denial of gun purchases broke down as follows: 76 percent - Criminal history of a felony8 percent - Criminal history of domestic violence6 percent - Criminal history of other offenses (multiple DUIs, non-NCIC warrants, etc.)3 percent - Criminal history of drug abuse3 percent - Domestic violence restraining orders What About the Gun Show Loophole? While the Brady Act has blocked more than three million gun sales to prohibited purchasers since taking effect in 1994, gun control advocates contend that up to 40 percent of gun sales occur in â€Å"no questions asked† transactions that often take place over the Internet or at gun shows where, in most states, background checks are not required. As a result of this so-called â€Å"gun show loophole,† the Brady Campaign to Prevent Gun Violence estimates that about 22% of all gun sales nationwide are not subjected to Brady background checks. In an effort to close the loophole, the Fix Gun Checks Act of 2015 (H.R. 3411) was introduced in the House of Representatives on July 29, 2015. The bill, sponsored by Rep. Jackie Speier (D-Calif.), would require Brady Act background checks for all gun sales including sales made over the Internet and at gun shows. Since 2013, six states have enacted similar laws.

This global warming has brought changes in climate, including making perennial snow mountains melt, thereby adversely affecting not only human beings but also other living species. This dangerous situation is being taken very seriously by the world. In the past the perennial snow mountains of Tibet had very thick snow. Older people say that these mountains were covered with thick snow when they were young and that the snows are getting sparser which may be an indication of the end of the world. It is a fact that climate change is a slow process taking thousands of years to realize its effect. Living beings and plant life on this planet also undergo change accordingly. Mans physical structure too changes from generation to generation along with the change in climatic conditions. Because of the growth in the population, a large number of trees are cut for fuel, and to reclaim land for agricultural cultivation. In the case of Tibet, too, the Chinese have now destroyed its ancient trees in a similar way to shaving a mans hair off. This is not simply the destruction of trees but it also means harming what belongs to the Tibetans. Similarly, the continuing decline in forests in many parts of the world, including America, is adversely affecting the already changing global climate, thus upsetting the lives, not only of mankind, but also of all living beings. Similarly, the harmful effect on the atmosphere brought about by chemical emissions in industrialized countries is a very dangerous sign. Although this is a new thing for us Tibetans, the world is paying a lot of attention to this problem. It is the responsibility of us, who speak of the welfare of all sentient beings, to contribute towards this. Since I too have a responsibility in this matter, (i.e. to work for the protection of the environment and to see that the present and future  generations of mankind can make use of refreshing shade and fruits of trees), I bought these seeds of fruit-bearing trees with part of my Nobel Peace Prize money to be distributed now, to people representing different regions (all the continents of the world are represented here) during this Kalachakra gathering. These seeds have been kept near the Kalachakra mandala for purification and blessings. Since these include seeds of apricot, walnut, papaya, guava, etc., suitable for planting under varying geographical conditions, experts in respective places should be consulted on their planting and care and, thus, you all should see my sincere aspiration is fulfilled.

The Artistic Aspect of Architecture Architecture is undeniably one of the most powerful forms of art. Buildings have the ability to loom in the distance when seen from afar. As you approach it more and more details can be seen. Minute intricacies such as stone quality, texture, and perhaps some ornate detailing become apparent. Even standing at a doorway can provide some involved feelings. Does the building seem to invite the viewer inside with elaborate carvings and an open view to the interior? Or does it intimidate the viewer with its massive proportions making them feel insignificant and trivial? When inside the architecture as a medium the viewer is surrounded by and grasped within its walls and ceiling. This quality is one unique to architecture because it is the only form of art to totally surround its viewer with such magnitude. Whether one turns to the left or right, looks up or down, ceilings or walls are constantly presented to the viewer who stands amidst the intended space and substance. A line is drawn between buildings erected to serve a mere function and those which are made to integrate an influential quality into all who happen to see them often through use of extravagance. The latter can be propelled into greatness based on whether or not they are successful in carrying out with this vision set forth by their creators. This is what sets apart an ordinary building from an impressive and monumental wonder. It is interesting to note how a building is set apart from others of its time when this building is made to represent the people as a whole. Of course this building will surpass the more ordinary ones juxtaposed within the city. Of course the society or ruler would like to put their â€Å"best ... ...d and venerated being. On the other hand, Judas’ fate of damnation is shown by his contact with the devil clutching him. A final statement is made in the Scrovegni Chapel on behalf of all the buildings discussed here. God is depicted at the top of the altar dispatching Gabriel. God is placed at the top to honor Him and show His superiority to all that enter the chapel. Man’s yearning to glorify God (or gods in the case of the Pantheon) has been the key driving force in the construction of many fabulous buildings. Granted there are those that deviate from this pure motive in order to satisfy self-glorification through the artwork, but basically the root of all these wonders is the chance to glorify the Supreme Being. It is wonderful to see the end results now and witness how art is so much a part of worship and of the success of architectural organization.

IT Professionals and Ethical Issues Essay

IT professionals have to observe a greater degree of accountability in the practice of their profession. Their works, which have been used by many consumers, have offered not only benefits, but also of harms and risks (Bayles, 1989; Nissenbaum, 1994). Faulty and malfunctioning computer systems have cost lives, money, valuable time, and other valuable resources (Bayles, 1989). When the undesirable outcomes occur, they became the center of controversy, are these intentional, accidental, or obvious outcomes of recklessness or negligence? As a result, imposing a strong culture of accountability has become a bigger challenge for the people in the computing community. The solution to achieving a reliable standard for setting a degree of responsibility in the practice of the IT profession is by setting the degree of reliability and safety for all IT projects (Bayles, 1989; Nissenbaum, 1994). In the computing world lie many barriers which obscure accountability (Nissenbaum, 1994). First is the problem of many hands. IT products are produced by more than one individual. When problems occur, everyone points their fingers at one another. It’s hard to identify who is to be held accountable for a mistake. Second is the problem of bugs, the natural hazards of programming. It has been used by some as an excuse for their mistakes. Third is the problem of blaming the computer in case of errors. Machines do fail, but probably due to one or more factors. It could be due to poor design, or of improper handling by its operator, yet it’s still a human error. Lastly is the problem of ownership without liability. Product owners and developers don’t want to take liabilities in case their products fail. To control these barriers, the computing community has set a suitable standard for achieving reliability and safety which evolves together with the evolution of knowledge (Bayles, 1989; Nissenbaum, 1994). The standard will then serve as the fundamental basis for setting a standard degree of accountability for those who cause harms and risks of using IT products. However, the bottom line is everyone has to learn how to take responsibilities. IT professionals have to think about not only the welfare of their investors, or their bosses, but also the welfare of its consumers (Bayles, 1989). They have to keep the integrity of the profession of computing, and struggle to maintain the people’s confidence in it. The profession has to be used to promote the welfare of all individuals. It should not be used to cause harm, or to steal, or to invade the privacy of the people (Bayles, 1989; Nissenbaum, 1994). The discipline has to start in every individual.

Ayres himself found the on to be euphonious in some expressions, but superfluous in others. Later commentators seem to have missed the euphony. Research Paper Abstract on Child Abuse Research Paper Abstract on Child Abuse Child abuse is defined as a non-accidental behavior by parents, caregivers, or any other adults that is outside the norms of conduct and can cause physical or emotional harm to a child or a young person (Bromfield, 2005). There are five main types of child abuse: physical abuse emotional maltreatment neglect sexual abuse the witnessing of family violence Physical abuse is defined as a non-accidental use of physical force that can cause harm to a child. This includes: shoving, hitting, slapping, shaking, throwing, punching, kicking biting, burning, strangling and poisoning (Bromfield, 2005). Physical abuse can also depend on the age of a child and the nature of the behavior: an action which can be regarded as dangerous and potentially harmful for a child of a certain age can also be regarded as physical abuse. Emotional abuse is defined as an inappropriate verbal or symbolic act towards a child that can lead to childs problems on a psychological level. There are five main kinds of psychological maltreatment: rejecting: the adult refuses to acknowledge the childs worth and the legitimacy of the childs needs; isolating: the adult cuts the child off from normal social experiences, prevents the child from forming friendships, and makes the child believe that he or she is alone in the world; terrorizing: the adult verbally assaults the child, creates a climate of fear, bullies and frightens the child, and makes the child believe that the world is capricious and hostile; ignoring: the adult deprives the child of essential stimulation and responsiveness, stifling emotional growth and intellectual development; corrupting: the adult mis-socializes the child, stimulates the child to engage in destructive antisocial behaviour, reinforces that deviance, and makes the child unfit for normal social experience (Garbarino et al. (1986) p. 8) Another kind of abuse is neglect. It means that either parents, or caregivers do not provide children with enough care as it is expected compared with the norms of society. It consequently can affect childs physical and psychological development. Types of neglect include: physical neglect: characterized by the care givers failure to provide basic physical necessities, such as safe, clean and adequate clothing, housing, food and health care; emotional (or psychological) neglect: characterized by a lack of caregiver warmth, nurturance, encouragement and support (note that emotional neglect is sometimes considered a form of emotional maltreatment); educational neglect: characterized by a care givers failure to provide appropriate educational opportunities for the child; and, environmental neglect: characterized by the care givers failure to ensure environmental safety, opportunities and resources (Dubowitz, Pitts, Black, 2004) Sexual abuse is defined as a use of a child in any sexual activity, with or without consent, and often without childs understanding. Sexual abuse can happen within a family between family members, with an adult with no familiar relation to a child, or an adult that is in a position of power and authority over the child. Witnessing of family violence is a kind of an abuse that happens when a child is present while a family member is subjected to any kind of violence. They were not the only group interested in diamond trade at that time. Some Lebanese traders used to smuggle diamonds from Sierra Leone to Liberia. The country's government has played a major role in perpetrating these conflicts surrounding diamonds. After the country gained its independence, a law was passed that allowed independent local miners to obtain licenses. This fueled illegal diamond trade. To make matters worse, the Sierra Leone kept getting inadequate leaders. One such leader was Prime Minister Steven. He gave himself mining rights and allowed a lot of illegal trade just to popularize his name. This occurred in the late 1960s. He was the one who perpetrated the end of De Beers Company and his ally Mohamed bought shares from De Beers (it had decided to stop involving itself in Sierra Leone). As the country approached the end of the century the government kept being more and more corrupt thus allowing plenty of foreigners to participate in this illegal trade. After the reign of Prime Minister Steve, another leader took over called Momoh. During the 90's, Sierra Leone started a civil war. This was as a result of unrest among citizens who felt that their needs were not being met by the current government. Profits from diamond trade were simply going to a few powerful individuals. A rebel movement called the Revolutionary United Front (RUF) began its activities in the year 1991. It claimed that it was fighting for the rights of the common man by asking for equitable distribution of profits earned from the diamond trade. This group of rebels obtained resources for acquiring firearms through diamond smuggling. This meant that illegal trade kept getting worse and worse. (Janine, 2006) There are a number of human rights that were violated by the ongoing civil war in Sierra Leone it lasted for nine years. The rebels took away the right to life because a numerous number of individuals were killed through the dreaded RUF rebel group. About seventy five thousand people were killed through this war. They wanted to instill fear among the locals so that they could yield to their commands. RUF also wanted to illustrate that the government of the day was powerless and couldn't even protect its people. The war surrounding diamond trade also caused immense suffering among the locals. Some of them were mutilated and their body parts were placed in bags. This was done by most of the rebel soldiers. Women and children were not spared as many were tortured, raped, and taken as captives to work as sex slaves. A number of these women contracted sexually transmitted infections or bore illegitimate children. In Sudan, for example, a married person found guilty of adultery is executed by stoning; an unmarried person receives 100 lashes. In Afghanistan during the Taliban regime, a woman and a man were stoned to death in public using palm-sized stones for non-marital sex. The man died within minutes but the woman had to be finished off by dropping a large chunk of stone over her head. First, the irrevocability of the death penalty means that there is no hope of correcting an injustice committed against a convict later found to be innocent. Second, it violates the principle of restorative justice, which should replace the principle of retributive justice. Third, it has been proven by empirical evidence that it in no way deters crime or helps in crime prevention. Fourth, racial biases affect any objective application of the death penalty law.  Human errors and frailty, as well as the lack of adequate forensic facilities in some countries, have led to many convictions that later turn out to be wrong. In a situation where the maximum penalty that may be meted out is life imprisonment, the State may still be able to provide reparation for an innocent man wrongly convicted. He will be allowed to go free and will even be given damages. In a country wher e the death penalty is legal, the finality of the sentence of death renders any mistake in convictions irreversible.  The problem is seriously considering that, according to a death penalty information website, "since 1973, at least 121 people have been released from death row after evidence of their innocence emerged. During the same period of time, over 982 people have been executed. Thus, for every eight people executed, we have found one person on death row who never should have been convicted."  This issue has generated widespread public outrage and is perhaps one of the more compelling reasons as to why the anti-death penalty advocates are gaining ground. Says Haines (125):  An analysis of newspaper coverage suggests that flawed convictions, in which possibly innocent persons either suffer or narrowly escape execution, are especially potent threats to public support for capital punishment. The injustice brought about by sending an innocent man to prison is magnified a th ousandfold by the horrific idea that such an innocent man might be wrongly executed. There can be no recompense that may be provided to the dead. In recent times, we have seen a paradigm shift from retributive justice, where a convict is made to pay for grievances to the community he belongs to, to restorative justice, wherein a recognition is made that a crime has been committed and a wrong has been done, but the convict is still a member of the community and is perceived as a human being with the capacity for reform.Â
